These terms of use (the “Terms”) apply to your use of this website (the “Website”), which is operated by BUCOF Pty Ltd (ABN 80 688 646 406) (“BUCOF”, “we”, “us” or “our”). By using the Website, you agree to these Terms. If you don’t agree, please don’t use it.

1. About these Terms

These Terms cover the Website only. Our product, BUCOF Capture, is provided to customers under a separate agreement. If that agreement and these Terms conflict, the agreement applies to BUCOF Capture.

If you use the Website on behalf of an organisation, you agree to these Terms for that organisation as well as for yourself.

2. Using the Website

You may use the Website to learn about BUCOF and our products and to request a demo. When you use it, you must not:

  • break any law, or infringe anyone’s rights, including their privacy or intellectual property
  • try to get unauthorised access to the Website, the systems behind it or any connected network, or probe or test their security
  • interfere with the Website, for example by introducing viruses or other harmful code, or by overloading it
  • copy or extract the Website’s content in bulk with automated tools, except as a search engine or similar service that follows our robots.txt file
  • send false or misleading information, pretend to be someone else or send spam through the demo form.

We may block your access to the Website, or part of it, if we reasonably believe you’ve broken these Terms.

3. Demo requests

The information you give us when you request a demo must be accurate, and it must be yours to share. A request doesn’t create a contract or an obligation for you or for us, and we may decline it. We handle what you send as our privacy policy describes.

4. Information on the Website

  • The Website gives general information about BUCOF and BUCOF Capture. It isn’t engineering, legal, financial or contractual advice, so please get advice that suits your circumstances before you rely on it.
  • The projects, dockets, people, companies and figures in the app screens shown on the Website are fictional. They only illustrate how BUCOF Capture works.
  • Features, availability and our roadmap may change. The roadmap shows our current plans, not a promise that a feature will be delivered or when.
  • We work to keep the Website accurate and up to date, but we don’t promise that it’s complete, current or free of errors.

5. Intellectual property

We or our licensors own the Website and its content, including its text, design, graphics, photographs and software, and the BUCOF name and logo.

You may view the Website, print or save pages for your own reference and share links to it. Any other use, such as copying, changing, republishing or selling its content, needs our written permission, unless the law allows it.

The names and logos of other organisations and projects belong to their owners. They show where our team has worked, and they don’t mean that those organisations endorse BUCOF.

6. Links to other websites

The Website links to websites we don’t control, such as LinkedIn. We aren’t responsible for their content, availability or privacy practices, and a link doesn’t mean we endorse them.

7. Availability

We may change, suspend or stop the Website, or any part of it, at any time without notice. We don’t promise that it will always be available, or that it’s free of errors or viruses.

8. Your rights under the Australian Consumer Law

Nothing in these Terms excludes, restricts or changes any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that can’t be excluded (your “Non-excludable Rights”). These Terms apply only to the extent the law allows.

9. Disclaimer

Except for your Non-excludable Rights, the Website and its content are provided “as is” and “as available”. We exclude all warranties, conditions and representations that aren’t set out in these Terms, including about the Website’s accuracy, reliability or fitness for a particular purpose.

10. Limitation of liability

Except for your Non-excludable Rights, and to the maximum extent the law allows:

  • we aren’t liable for any loss or damage that arises from your use of the Website, from being unable to use it or from relying on its content, whether in contract, tort (including negligence), under statute or otherwise
  • we aren’t liable for any indirect or consequential loss, or any loss of profit, revenue, data, opportunity or goodwill
  • where the law lets us limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.

11. Indemnity

You indemnify BUCOF and our officers, employees and contractors against any loss, liability, cost or expense (including reasonable legal costs) arising from your breach of these Terms or your unlawful use of the Website, except to the extent that we caused it.

12. Privacy

Our privacy policy explains how we collect, use and protect personal information through the Website.

13. Changes to these Terms

We may update these Terms from time to time. We’ll publish the new version on this page with a new date at the top, and it applies from then on. If you keep using the Website after a change, you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.

15. General

  • If any part of these Terms is invalid or unenforceable, it will be read down as far as needed to make it valid, or severed if that isn’t possible, and the rest of these Terms will still apply.
  • If we don’t enforce a right under these Terms straight away, we haven’t waived it.
  • We may transfer our rights and obligations under these Terms, for example if our business is sold or restructured.
  • These Terms are the whole agreement between you and us about the Website. They don’t replace any agreement you have with us for BUCOF Capture.
